Major GST Relief: Key Decisions on ITC Protection and Refunds from the 57th Council Meeting
1. Changes Regarding Input Tax Credit (ITC) Protection
Protection for Genuine Buyers from Supplier Default: Previously, if a supplier failed to deposit tax or file returns, the ITC claimed by the buyer was often cancelled or penalized. Under the new decision, if the buyer possesses a valid invoice/challan, has actually received the goods or services, and has proof of payment, their ITC will not be cancelled directly due to the supplier's default. A special mechanism or safe harbor rule is being created for its administrative resolution.
Automated Invoice Matching: Systems on the GST portal and return system (including GSTR-1A) are being strengthened to make it easier to match bills between buyers and sellers in real-time, which will allow errors to be corrected early and eliminate subsequent credit reversal hassles.
2. Changes Regarding Refunds
Refund of 'Input Services' in Inverted Duty Structure:
Problem: When the GST rate on finished goods is lower, but the GST rate on raw materials is higher, it is called an "inverted duty structure". Until now, only the accumulated excess tax on raw materials (inputs) could be refunded, but GST paid on services (input services such as transport, IT services, consultancy fees, etc.) could not be recovered.
New Decision: As per the Council's recommendations, the facility to claim inverted duty refunds has been extended to credits given on input services received starting November 1, 2026. This will free up a massive amount of blocked capital for manufacturing and service sectors.
Risk-Based Faster Automated Refunds: Approval has been granted to launch a risk-based automated system for exporters and specified taxpayers, where up to 80% of the refund amount will be automatically deposited into the taxpayer's bank account within just 3 working days.
Old Small Balance Refunds and Application Facility: The facility to clear old small refund balances stuck with businesses is also being simplified so that cash flow is not blocked unnecessarily.
Summary Table
1.Supplier Default & ITC

New Decision: Genuine buyer's ITC will not be cancelled directly if valid proof is provided.
2.Inverted Duty Refund
Previous System: Available only on raw materials (Inputs).
New Decision: Will also be available on Input Services starting November 1, 2026.
3.Refund Processing Time
Previous System: Required manual verification and took a long time.
New Decision: 80% of the refund will be provided within just 3 working days via an automated system.
